APPROVAL OF DISPOSITIONS IN DIVERSE ENTITIES OF THE COUNTRY PROHIBITING THE DISTRIBUTION, EVEN DISTRIBUTION FREE OF CHARGE, OF STRAWS, PLASTIC BAGS AND STYROFOAM CONTAINERS.
During 2018 and the first months of this year, different States and Municipalities of the country have approved modifications to their environmental laws and regulations, respectively, to prohibit the use and distribution, even the distribution free of charge, of straws and, in some cases, of plastic bags and Styrofoam containers in commercial, industrial and services establishments within their territories.
Stipulations of this nature have been approved, so far, in the in the following Entities:
• Baja California Sur
• San Luis Potosi
• Coahuila de Zaragoza
• Nuevo Leon
• State of Mexico (Municipalities of Toluca,
Tlalnepantla and Coatepec)
• Queretaro (Municipality of Queretaro)
Regardless of the positive effects that this type of measures has in the environment, their implementation may considerably affect the activities carried out in the commercial, industrial and services establishments, that use or distribute this type of products in the Entities and Municipalities previously mentioned; if not implemented properly by the authorities.
Subject to reviewing each particular case, we consider that these provisions may present vices or irregularities regarding their content and approval proceeding that could be challenged by the affected private parties.
