On April 16, 2019, the National Agency for Industrial Safety and Environmental Protection (ASEA) published Mexican Official Standard NOM-001-ASEA-2019 (NOM-001) in the Federal Official Gazette (DOF), which:
- Establish the criteria to determine which wastes from the hydrocarbon sector must be considered as Special Handling Wastes.
- Signals the criteria to determine which wastes, both Special Handling and Hazardous, will be subject to a Handling Plan, same that must comply with the dispositions set forth in NOM-001 and be approved by ASEA.
- Determine the elements for the development and management of the Handling Plans for bothHazardous Wastes and Special Handling Wastes of the sector.
NOM-001 will enter into force next June 15, 2019. By that time, all those Regulated Parties that do not hold a Handling Plan will have a 120-calendar day period to comply with the standard and submit their Handling Plan for the ASEA’s evaluation.
Those Regulated Parties that, prior to June 15, have already a Handling Plan implemented and authorized can continue to operate with the same. Nonetheless, in case there are some modifications that should be submitted to ASEA’s consideration, said Regulated Parties will have to consider the dispositions set forth in Chapter 7 of NOM-001 at the time of preparing said modification.
Finally, those Handling Plans that are in an evaluation process by ASEA prior to June 15 will continue to be evaluated on the basis of the dispositions in force at the time of their submission.
