SECOND STAGE OF THE PROHIBITIONS IN MATTERS OF DISTRIBUTION AND SALE OF SOLE USE PLASTICS, FORESEEN IN THE SOLID WASTES LAW OF THE FEDERAL DISTRICT, ENTER INTO FORCE.

 

Mexico City, January 5th, 2021.

 

As per Transitory Article Third of the Decree by which various provisions of the Solid Waste Law of the Federal District, are added and amended, regarding the use of plastics and compostable products, (the Decree), published on June 25th, 2019; the prohibition of commercializing, distributing and handing in the following products to consumers, entered into force last January 1st, 2021:

 

1.Non-compostable products listed below, when manufactured, totally or partially, with plastic and designed for their disposal after a single use:

  • Forks.
  • Knives.
  • Spoons.
  • Mixing sticks.
  • Plates.
  • Straws or stirrers (unless it refers to straws for medical assistance).
  • Cotton swabs.
  • Balloons and balloon rods.
  • Glasses and their respective lids.
  • Trays to transport food.
  • Tampon applicators.

 

2. Products containing added micro plastics intentionally.

 

3. Sole use coffee capsules manufactured with low potential plastic materials.

 

In this regard, as of last January 1st, 2021, the commercialization of the abovementioned products is prohibited in Mexico City. Said prohibition does not apply to:

  • Compostable products that are incorporated into a handling plan that guarantees its proper management and composting,
  • Those products that are factory integrated to provide hygiene in the product’s consumption, or
  • Products used for reasons of safety, health, sanitation, medical use and safety of other products, so long there is no compostable alternative.
